What should I do if my business is struggling financially?

If your business is facing financial difficulties, it’s important to take action as soon as possible. Contact a financial advisor or restructuring firm to assess your situation. Early intervention can help prevent further deterioration and improve your chances of a successful recovery.

What is restructuring?

Restructuring is the process of reorganizing a company’s finances, operations, or structure to improve performance, resolve financial difficulties, or address changes in the market. This often involves renegotiating debt, cutting costs, selling non-core assets, and reorganizing management or business units to enhance long-term sustainability.

Is a bankruptcy filing required in restructuring?

Not all restructuring requires filing for bankruptcy. If the situation can be resolved through negotiation, the business and its creditors may enter into a binding agreement, often called a “workout agreement” or a “composition agreement”. However, if the parties involved can’t come to an agreement through negotiation, bankruptcy court can still be avoided through the appointment of a receiver. Receivership statutes are legal frameworks for protecting the value of assets. They involve the oversight of a court, and therefore offer solutions to parties through legal mechanisms. For most businesses, bankruptcy filings are a last resort and can be a costly alternative to other restructuring methods.

What is a receiver?

A receiver is appointed by a court, secured creditors or even by the owners of the business itself to take control of a company’s assets to manage, sell, or liquidate those assets to satisfy debts or resolve issues related to the preservation of value. This typically occurs when a business or asset of the business is in financial distress, and creditors are seeking to recover outstanding liabilities. In cases where the receiver is requested by the owners of the company, the receiver is known as a “voluntary receiver”. The receiver’s role is to exercise judgment and expertise to protect and enhance the value of the assets, and they may work to restructure the business, sell assets, or oversee a liquidation process.

How long does a restructuring take?

The duration of a restructuring process depends on the complexity of the business’s situation. Simple restructurings may take a few months, while more complex cases involving extensive debt renegotiation or operational changes could take longer. We aim to deliver efficient, effective solutions with minimal disruption to your operations.

Are you a law firm?

No. We are restructuring and strategy consultants and in some cases offer interim executive services. We are not a law firm. We work closely with lawyers, and our decades of experience make us highly effective “clients”.

What early 20th century economist is the inspiration for the name of your blog?

Our blog, Schumpeter’s Gale, is inspired by Joseph Alois Schumpeter (February 8, 1883 – January 8, 1950), who was an Austrian political economist. He served briefly as Finance Minister of Austria in 1919. In 1932, he emigrated to the United States to become a professor at Harvard University, where he remained until the end of his career, and in 1939 obtained American citizenship.

Schumpeter was one of the most influential economists of the early 20th century, and popularized the term “creative destruction”.His magnum opus is considered Capitalism, Socialism and Democracy.
